Employers’ liability is a legal requirement for any business with staff – paid, voluntary or temporary. Accidents and slip ups at work can happen to anyone, at any time.

What is employers’ liability insurance?

Employers' liability insurance is a legal requirement under the Employers’ Liability Act 1969 if you have anyone working for you. It’s there to protect you from claims made by your employees if they get accidentally injured or become ill because of working for you. It covers the compensation costs and legal fees involved with handling these types of claims. If you’re found to be without employers’ liability you could be fined £2,500 by HMRC for every day you are uninsured.

What counts an ‘employee’?

An employee doesn’t only mean someone who works for you on a paid part or full time basis. In this sense, it covers a broad spectrum of employee types, such as:

• Under a contract of service or apprenticeship with you
• Who is:
  • a) Employed by you or on your behalf on a labour only basis
  • b) Self-employed
  • c) Hired to you or borrowed by you from another employer
  • d) A voluntary helper or taking part in a work experience or training scheme
