    Business Pyjamas – Competition Terms and Conditions

    The Promoter of this competition (the “Competition”) is AXA Services Limited, whose registered address is at 5 Old Broad Street, London, EC2 1AD (the “Promoter”, “we”) which is a service company to AXA Insurance UK Plc, which is part of the AXA Group of companies.

    “AXA Group” means AXA UK plc and its subsidiary companies, any holding company of AXA UK Plc and any subsidiary companies of such holding company, as such terms are defined in section 1159 of the Companies Act 2006.

    By entering into this Competition you agree to be bound by these terms and conditions and by any other requirements set out in any related promotional material. Entries that do not comply in full with these terms and conditions will be invalid and not considered in the Competition.

    How to Enter the Competition and Eligibility:

    1.To enter into this Competition, you must take a photograph of yourself wearing the clothes you wear at work (your “business pyjamas”) and do one of the following: 

    a. share your photograph and telling us what you wear at work on your blog; or
    b. share your photograph on Twitter using #BusinessPyjamas and notify us at @AXABizTeam; or
    c. share your photograph on AXA Business Insurance’s Facebook page (at facebook.com/AXABusinessInsurance) 

    2. Entry is limited to one entry per person by one of the methods described in paragraph 1 above. We will only consider one entry per entrant and we will not consider duplicate entries. 
    3. Your entry must be of yourself only. You may not submit any photograph of any third party. You may not submit any photograph, material or content in which a third party owns the intellectual property rights. 
    4. You may not submit inappropriate, defamatory and/or offensive images or material. 
    5. The Promoter reserves the right to remove what we deem to be any inappropriate, defamatory and/or offensive images or material. If you enter any such images your entry will not be considered in the Competition. We also reserve the right to remove any such entries from Twitter and Facebook. 
    6. The Competition is open to all UK residents over the age of 18 who are resident of the Great Britain, excluding employees of any companies within the AXA Group of companies and their associated, affiliated or subsidiary companies, and their families, agents or anyone connected or involved in the administration of this Competition, who have access to the internet. 
    7. The commencement time and date for entry into this Competition is 2pm on Friday 4th July 2014 and the closing date and time for entries is 2pm on Friday 1st August 2014. Entries received after the closing date and time will not be eligible for entry in the Competition. 
    8. No purchase is necessary. 
    9. The Promoter reserves the right to withdraw or amend this Competition at any time without notice.

    The Prize:

    10. There will be one prize comprising an iPad Mini (16GB, Wi-Fi only) (the “Prize”.)
    11. The Promoter reserves the right to substitute the Prize for a prize of equivalent or greater monetary value if this is necessary for reasons beyond its reasonable control. There will be no cash alternative and the Prize is not transferable.
    12. The Prize will be sent, at the Promoter’s expense by special delivery to the postal address provided by the Prize winner within 7 days of the Prize winner providing their postal address to us.

    How the Winner Will Be Selected and Notified:

    13. There will be one Prize winner (the “Winner”).
    14. An independent third party will create a shortlist from the entries by 2pm on Wednesday 6th August 2014. A panel of three independent judges will then each choose their top three favourite entries from the shortlist to produce a final shortlist of 9 entries. The panel of three judges will select the Winner from the final shortlist by 2pm on Wednesday 13th August 2014.
    15. The independent third party will select entrants for the shortlist on the basis of the best and wackiest entries. The independent judges will select the final shortlist and the Winner on the basis of their favourite entries/entry. The decision on the Winner will be final and legally binding on all entrants. No correspondence will be entered into.
    16. Within 7 days of the decision on the Winner, the Winner will be contacted using the method by which the Winner entered into the Competition, namely: a. if the entry was submitted via Facebook, we will respond to the post publically asking you to contact us via a direct message. b. if the entry was submitted via Twitter, we will try to contact you via direct message. If this is not possible, we will reply to your entry publically. c. if the entry was submitted via a blog we will contact you via your blog (email address or contact form).
    17. We will make repeated attempts to contact the Winner. However, in the event that the Winner cannot be contacted using the above methods within 14 days of the decision on the Winner being made or if the Winner does not respond to us, we reserve the right in our absolute discretion to withdraw the Winner’s entitlement to the Prize and to award the Prize to an alternative entrant from the final shortlist.
    18. We will publish details of the Winner and the Winner’s entry on the campaign page at http://www.axa.co.uk/insurance/business/business-pyjamas by no later than 2pm on the 29th August 2014.

    Promotions and Publicity:

    19. The entrants hereby assign to the Promoter, for the benefit of itself and AXA Group of companies together with their respective licensees, successors and assigns, free of charge all copyright and any other intellectual property rights which may arise in the photographs submitted for the Competition (whether in whole or in part and together with any alternations or distortions of any nature).
    20. The Promoter reserves the right to publish all and any photographs submitted to the Competition by entrants in the Promoter’s campaign gallery which can be found at http://www.axa.co.uk/insurance/business/business-pyjamas. Publication of your photograph at such gallery will not guarantee that your entry will be shortlisted.
    21. The Winner agrees to use of their name and photograph being used in our campaign page at http://www.axa.co.uk/insurance/business/business-pyjamas and in any promotional activity following the decision on the Winner.

    General and Limitation of Promoter’s Liability

    22. If any paragraph of these terms and conditions should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these terms and conditions and the remaining paragraphs shall survive and remain in full force and effect.
    23. By entering this Competition, you agree that the Promoter is not liable for any loss, damage or personal injury whatsoever suffered or sustained in connection with this Competition (including but not limited to direct, indirect or consequential losses, loss of profit, income or goodwill), the use of the Prize or any act or omission (whether negligent or not) of the Promoter or its affiliates, save for any liability which cannot be excluded by law (including fraud, gross negligence or for death or personal injury caused by the Promoter's or its affiliates’ negligence).
    24. These terms and conditions shall be governed by and construed in accordance with the laws of England and wales and any disputes arising out of or in connection with the terms and conditions shall be subject to the exclusive jurisdiction of the Court of England and Wales.

    Data Protection

    25. The Promoter will use the personal information that you provide to enter you into the Competition and to notify you if you are a Winner. The personal information will not be used for any other purpose. By submitting your entry to the Competition, you confirm that you consent to the use of your personal information for these purposes.
